What MPCB consent means
The Maharashtra Pollution Control Board, or MPCB, is the state authority that regulates water and air pollution under the Water Act of 1974 and the Air Act of 1981. Any project that generates sewage or effluent, including housing societies with an STP and industries with an ETP, needs the board's consent to build and to operate that facility.
In plain terms, consent is the government's permission that says your treatment plant is designed correctly and is being run so that what leaves your site meets the required standards. Without it, an STP or ETP is operating illegally.
Consent to Establish versus Consent to Operate
There are two main approvals, and they come at different stages of a project. Understanding the difference avoids costly delays, because you cannot skip straight to running the plant.
The first authorises construction, and the second authorises actual operation once the plant is built and proven.
- Consent to Establish (CTE): applied for before construction begins, based on the project design, expected effluent and proposed treatment. It confirms the plan is acceptable.
- Consent to Operate (CTO): applied for after the plant is built and commissioned, confirming it actually meets standards. It is time-bound and must be renewed.
- Renewal: the CTO is granted for a defined period and has to be renewed before it lapses to keep operating legally.
- Category matters: projects are classified by pollution potential and scale, which affects the process and the authority level involved.
The application process and documents
Applications are made through the MPCB's online system, and the board reviews the design, the treatment technology and the projected discharge quality before granting consent. For many projects an inspection is part of the process.
Being organised with documentation makes approval far smoother, since incomplete applications are the most common cause of delay.
- Project details, site plan and layout of the STP or ETP.
- Design basis, capacity in KLD and the treatment process description.
- Expected effluent characteristics and the standards the plant will meet.
- Ownership, land and statutory documents as required for your category.
Staying compliant after you get consent
Getting consent is the start, not the finish. The board expects the plant to run continuously and to keep meeting the conditions written into the consent, and it can inspect at any time. For many industries, online monitoring now streams key parameters directly to the board.
Good compliance is mostly good housekeeping: run the plant, keep records, test the output, and renew on time. A maintenance contract and a trained operator make this routine rather than stressful.
- Operate the plant continuously and never idle it to save power.
- Maintain logbooks for flow, power, chemicals and sludge disposal.
- Get the treated water tested by an accredited laboratory at the required frequency.
- Track and renew the Consent to Operate well before it expires.
